The website www.rubertquintanart.com is dedicated to the exhibition, promotion, and sale of artworks by Rubert Quintana, who also signs his work under the names Gabriel and Kingtana. The site offers both original artworks and limited edition reproductions, each clearly identified in the product description.

3. Copyright and Intellectual Property

All artworks and visual content on this site, whether signed as Rubert Quintana, Gabriel, or Kingtana, are the sole intellectual property of Rubert Quintana.
Unauthorized use, reproduction, distribution, modification, or publication of any artwork, image, text, logo, design, or any other site element is strictly prohibited and will be subject to legal action under U.S. and international copyright laws.

4. Product Descriptions

Each artwork listing will specify whether it is an original or a limited edition reproduction.
Reproductions will include a unique serial number, indicated on the artwork itself and/or on the accompanying certificate of authenticity.

5. Pricing, Payment, and Invoicing

All prices are listed in U.S. dollars (USD) and include applicable taxes unless otherwise stated.
Payments are processed through secure gateways (e.g., PayPal, Stripe, Zelle, bank transfer, or others specified on the site).
A sales contract is only valid upon full receipt of payment and confirmation from the artist.

6. Shipping and Delivery

Artworks are shipped via reputable carriers with protective packaging and tracking.
Shipping costs, customs duties, insurance, and any additional charges are the buyer's responsibility, unless otherwise indicated.
Once the artwork is handed over to the carrier, all risk of loss or damage transfers to the buyer.

7. Returns and Claims

Due to the unique nature of artworks, returns are not accepted for reasons of personal preference or change of mind.
If a piece arrives damaged or with a manufacturing defect (in the case of reproductions), the buyer must notify the artist in writing within seven (7) calendar days of receipt, including clear photographs and a description of the issue.
Claims submitted after this period will not be accepted. The artist reserves the right to approve or deny returns based on an individual assessment.

8. Limitation of Liability

Rubert Quintana shall not be held liable for indirect, incidental, punitive, or consequential damages arising from the use of this website or the purchase of artworks.
In any event, total liability shall be limited to the actual amount paid by the buyer for the artwork.

9. Modifications

Rubert Quintana reserves the right to amend these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date.

10. Data Protection and Privacy

This site respects your privacy. Personal information (name, address, email, phone, payment details) will only be used for processing orders and communications related to the site. Your information will not be shared with third parties without your explicit consent, except as required by law.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of Florida, United States of America. Any dispute related to the interpretation or enforcement of this agreement shall be submitted to the competent courts of said state.
